Man accused of raping young woman on night out

A man has gone on trial at the Central Criminal Court accused of the rape and sexual assault of an 18-year-old girl who was on a night out in Kilkenny.

The 24-year-old man, who cannot be named for legal reasons, has pleaded not guilty to charges of rape and sexual assault of the woman on April 27, 2008.

Mr Michael Durack SC, prosecuting, said it was the State’s case that in the early hours of that morning the complainant was “drawn away from her friends” after they left a nightclub.

The accused brought the teen down a laneway where he is alleged to have pushed the girl’s head down and made her perform oral sex. It is then he allegedly raped her.

Mr Durack said the jury will hear how the complainant met the accused in a nightclub after she had a meal with her sister and friends and after they talked for a while they kissed briefly.

The jury will see CCTV footage confirming when various things had happened including the girl, her sister and her friends arriving at the nightclub at 11.37pm.

CCTV footage will show the accused and his friend arriving at the same nightclub at 1.07am. CCTV footage will show the accused and the complainant leaving the nightclub together.

The accused and the complainant go out of video range for 16 minutes. Mr Durack said the teen was drawn away from her friends and brought down a laneway where the alleged incidents took place.

She met up with her sister and her friends at 2.44am and told them she had been raped. Gardaí arrived at the scene within 15 minutes.

The trial continues before Mr Justice Patrick McCarthy and a jury of seven women and five men.
